To be terminated "without just cause" means that the employee has not done anything to legally justify the employer terminating the employee.  If a termination is without just cause, the reason for termination is often said by the employer to be due to "restructuring" or "layoff".

The term "without just cause" does not mean that the employer is not permitted to terminate the employee.  An employer is entitled to terminate as the employer chooses (subject to certain statutory exceptions).  However, the employer will have to compensate the employee who has been terminated without just cause. The vast majority of terminations are without just cause.

The types of legal rights or remedies available to employees terminated without just cause fall into two categories:

Statutory - rights enacted by parliament or a legislature

Common Law - laws formulated by judges
