Unjust Termination - Common Law - Age
In Canada, as an employee ages, that employee tends to be less valued in the marketplace, and it usually takes longer for the employee to find another position. Because of this fact, a terminated employee who is older, will likely receive a longer period of notice than a younger employee, all other things being equal. There is a question as to when an employee will be regarded as older. It is probable that anyone 50 or above will be regarded as older. For many occupations, even being in one's 40's is regarded as older, but this may have received insufficient recognition in the courts, at present.
