Unjust Termination - Common Law - Availability of Alternate Employment

The judicial explanation for requiring an employer to give reasonable prior notice of termination (or a payment in lieu of notice) is to allow the terminated employee sufficient time to find another job. Therefore, in order to quantify the amount of notice to which an employee is entitled, judges will take into consideration the availability of comparable employment. If comparable employment is scarce, this is a factor tending to increase an employee's notice period.
