When an employee has been injured at the workplace, the employee's injuries may initially render the employee incapable of returning to work. Once the employee is considered capable to perform the essential duties of the employee's pre-injury employment, the employee is entitled to return to work in the same or comparable employment. If the employee requires accommodation in the workplace due to the injuries, the employer is obliged to make such accommodation, so long as the accommodation does not cause the employer "undue hardship." If the injured worker's rights are not honoured, the worker can seek enforcement through the Workplace Safety and Insurance Board (formerly the Workers' Compensation Board).
