An employer has an obligation under the Occupational Health and Safety Act to ensure that an employee's workplace is safe. Employees have a right to complain if the employer fails to ensure the safety of the workplace.
Sometimes, an employer may attempt reprisal against an employee seeking enforcement of a right to a safe workplace. Sometimes the reprisal may take the form of termination of that employee's employment. An employee who has been terminated due to such a reprisal has the right to make an application to the Labour Relations Board for reinstatement and payment of back pay. |
