Unjust Termination - Statutory - Non-Federally Regulated - Termination Pay

Province of Ontario- Employment Standards Act

As previously indicated, employees terminated without just cause (who are not federally regulated) are entitled to a guaranteed minimum payment of "Termination Pay".

Employees terminated without just cause are entitled to Termination Pay calculated as follows:

Length of Service Termination Pay Entitlement

3 months- less than 1 year                                                      1 week

1 year - less than 3 years                                                        2 weeks

3 years - less than 4 years                                                      3 weeks

4 years - less than 5 years                                                      4 weeks

5 years - less than 6 years                                                      5 weeks

6 years - less than 7 years                                                      6 weeks

7 years - less than 8 years                                                      7 weeks

8 years or more                                                                          8 weeks

As part of your guaranteed minimum, there may be additional statutory payments due to you as Severance Pay
